The business carried on by the deceased himself was selling goods on commission for others whereby a large sum of Debts appears to be due to him, but which were the property of his Constituents and all that belonged to him was his Commission arising upon the Sales which from a balance and state of his affairs made out since his death amounts to 279”3”2 The defunct a short time before his death had made a purchase of a parcel of Cotton yarns which haveSince been sold for ------  528”15”5

At Glasgow the ninth day of October Eighteen Hundred and thirteen years In presence of Thomas Falconer Esquire Commissary Depute of Glasgow Appeared William Cuthbertson Merchant in Glasgow Factor for the executors of the deceased Michael Jamieson Manufacturer in Glasgow who being solemnly sworn and examined deposes that the said Michael Jamieson died on the second day of April Eighteen hundred and thirteen and by his deed of Settlement dated the fourteenth day of January Eighteen hundred and thirteen and recorded in the Sheriff Court Books of Lanerk kept at Glasgow the seventh day of April last he conveyed his whole estate to John Jamieson William Jamieson and Isobella Jamieson his brother and Sister equally among them under the burdens therein mentioned That the desponent has been appointed by them to enter upon the possession and management of the personal or moveable estate of the said Michael Jamieson wherever situated and belonging or due benificially

To the deceased at the time of his death in so far as the same has come to the deponents knowledge and that the value of the said Estate is above the value of One Thousand five Hundred Pounds and under the value of Twenty hundred pounds All which is truth as the deponent shall answer to God (signed) Wm Cuthbertson, Thos Falconer

Follows the defuncts Settlement regd as Above ment I Michael Jamieson merchant in Glasgow Being resolved to make such a Settlement of my affairs as will prevent all differences that might arise at my death among my relations with respect to the succession to my means and Estate Therefore I have assigned & dispensed and made over and do by these presents assign dispone convey and make over to and in favor of John Jamieson William Jamieson and Isabella Jameson my brothers and Sister equally and among them share and share alike and to the Survivors or Survivor of them All and sundry Lands Heritages Taches Steadings no ones possessions Bonds Wadsets Decreets and abbreviates of adjudication and grounds and Warrants thereof Together with all and sundry goods gear debts sums of money and in general the whole effects means and estate heritable or moveable real or personal of whatever kind or denomination that shall happen to pertain and belong or be indebted resting owing to me at the time of my Death Together with the rights and title Deeds Bonds bills and other vouchers instructions and documents of the said debts and subjects and all action and execution that are competent to follow thereon Dispensing with the generality of this Conveyance and admitting and allowing these presents to be as valid executed and sufficient to all intents & purposes as if every particular of my sais subjects were herein verbatim engrossed and I surrogate and substitute the said John Jamieson William Jamieson and Isabella Jamieson and Survivors or Survivor of

them to call and pursue for recovery of the foresaid debts to obtain Decreets for the same and  cause them if necessary to be put in all due and lawful execution and to grant receipts and discharges or obtaining payment thereof in whole or in part which will be sufficient to the receivers But these presents are granted and to be accepted of by the said John Jamieson William Jamieson and Isabella Jamieson under the express condition and burden in the first place they shall make payment of the whole just and lawful debts I shall happen to be owing at my death with my sick bed and funeral charges Secondly that they shall immediately after my death and as soon as my funds can be gathered in lay out upon good and sufficient heritable security the sum of Six hundred pounds Sterling and take the rights payable to John Jamieson my father and Elizabeth King my mother in liferent during their joint and respective lives and to them the said John Jamieson William Jamieson and Isabella Jamieson in fee by which I mean that there shall be secured beyond risque to my father and mother an Annuity of Thirty pounds Sterling yearly and it is my wish that my brothers and Sister shall have the use of the rest of my means and Estate But that each of them should pay as I hereby burden each of them with payment of an additional sum of Five hundred pounds Sty yearly To my Father and Mother during their joint and respective lives so as to make the whole Annuity pay able to them Forty five pounds Sterling yearly and I hope my brothers and Sister will see that this Annuity is

regularly paid to them so as that they may live comfortably in their old age And I hereby nominate and appoint the said John Jamieson William Jamieson and Isabella Jamieson and survivors or Survivor of them to be my sole executors and to give up inventories and expede confirmations if necessary but I reserve to myself not only my own proper use and enjoyment of the foresaid Subjects and Estate during all the days and years of my life But also full power and liberty at any time I think proper or even upon death bed to alter or renew these presents in whole or in part as I shall see cause And Lastly I dispense with the delivery of these presents and declare that this Deed altho found in my repositories at my death or in the custody of any other person who may be intrusted with the keeping whereof undelivered shall nevertheless have the full force and effect of a delivered evident to all intents and purposes as if it was delivered in my own lifetime ??notur Unstanding? of any Law Practice or custom to the contrary And I consent to the Registration hereof in the Books of Council & Session or others competent herein to remain for preservation & Constitute Prori In witness whereof these presents written upon this and the two preceding pages of stamped paper by Robert Reid Clerk to Nathaniel Stevenson Writer In Glasgow are subscribed at Glasgow the fourteenth day of January One thousand eight hundred and Nineteen years Before these witnesses the said Nathaniel Stevenson and the said Robert Reid (signed) Michael Jamieson Nath Stevenson witness Robert Reid witness
